Terms & Conditions of Sale

General

All goods remain the property of Scotweigh Ltd until paid for by “the customer” in full.

Any damage, defects or shortages in supply of goods must be notified to Scotweigh Ltd within 48 hours of receipt.  Any claims submitted after this period will only be considered at the discretion of Scotweigh Ltd.

Any new goods supplied are covered by a 12 month “return to base” warranty, i.e. defective goods must be returned, at the expense of the customer, to Scotweigh Ltd for exchange or repair. 

Payment terms are 30 day monthly account, i.e. invoices raised by Scotweigh Ltd in month one should be settled in full by the end of month two.

All prices & specification contained in this pricelist are subject to change & modification without notice.

Hire

Goods supplied on hire are done so at the customer’s risk.  Any losses or damage caused while on hire will be charged for in full.  goods must be available for return or collection at the end of the agreed hire period.  If not available they will be subject to further hire charges until they become so.

Software

Software will be supplied to specification agreed between Scotweigh Ltd, “the customer” and the end-user (if different).  Demonstrations and/or trial versions will be provided for acceptance and any modification requested after this acceptance will be chargeable.

INTELLECTUAL property rights will belong to Scotweigh Ltd.  Software is provided “as is” and Scotweigh Ltd grants no warranties, expressed or implied – it is the responsibility of the customer and/or end-user to test the software and ensure it satisfies all requirements.  Scotweigh Ltd will not be liable for any damages including any incidental or consequential damages arising out of the use or failure of the software.  It is the responsibility of the customer and/or end-user to put in place contingency plans and systems.

 

Scotweigh Service Contract Terms & Conditions

1 Scotweigh Ltd shall make the required visits per annum to test and adjust if necessary, the equipment listed overleaf during normal working hours ( 9.00am – 4.30pm )

  • i) If during our normal working hours access is denied to machines without good reason, Scotweigh Ltd may, at its discretion, charge for any subsequent visit(s)
  • ii) Scotweigh Ltd may, at its discretion, charge for any visit(s) outwith these hours

2 Scotweigh Ltd shall make visits to repair or adjust the equipment to its normal operating condition when notified by the customer that the equipment is malfunctioning

  • i) If during our normal working hours access is denied to machines without good reason, Scotweigh Ltd may, at its discretion, charge for any subsequent visit(s)
  • ii) Scotweigh Ltd may, at its discretion, charge for any visit(s) outwith the hours stated in Section 1.

3 The maintenance service does not include any repairs, replacements or adjustments necessitated as a result of any cause other than fair wear and tear or fault, in Scotweigh Ltd’s opinion, caused by

  • i) Failure or fluctuation of power. Acts of God, Fire, Lightning, Flood, War, Terrorism or Ingress of foreign material. Acts of Vandalism or deliberate damage to machines

4 The maintenance service does not include any repairs, or replacements to castings, housings, goods fittings, glass, external power supplies, alkaline or rechargeable batteries.

5 If the customer requests a visit to repair damage to any of the above (sections 3 a and b) Scotweigh Ltd may, at its discretion, charge for

  • any such visit

6 Scotweigh Ltd shall not be liable to the customer or any third party for any loss of profit, contacts, or any other pecuniary loss arising from any malfunction or failure of any machine under service contract

7 The customer will be required to pay any fees due if reverification by a trading standards officer is necessary

8 Scotweigh Ltd reserve the right to increase the service contract premium on an annual basis but not prior to one year from the commencement date

9 Scotweigh Ltd reserve the right to change the terms of this service contract at any time and will give the customer at least two weeks written notice of any such changes

10 Scotweigh Ltd reserve the right to terminate this contact if the customer does not comply with the terms and conditions here listed. Scotweigh Ltd shall give the customer at least 2 weeks written notice of termination
